Terms of Service

1. Overview

Catamaran Studios ("Catamaran Studios," "we," "us") designs, hosts, and maintains websites for local businesses, and can connect optional online ordering to a business's own point-of-sale account. By using our services or the customer portal, you ("you," the "Customer") agree to these Terms.

2. The service

We build and operate a website on your behalf and provide a customer portal to manage it, your integrations, and your billing. Online ordering, where enabled, connects to your own Square or Clover account so your menu and orders flow through the systems you already use.

3. Subscriptions and billing

Service is provided on a recurring subscription billed through our payment processor (Stripe). Fees are billed in advance each period. You can cancel at any time; cancellation stops future billing and, per our no-lock-in commitment, you keep your domain and your files. Except where required by law, fees already paid are non-refundable.

4. Ordering integrations and payments

If you enable online ordering, you authorize us, via OAuth, to access your own Square or Clover account to read your catalog and (where enabled) create orders and process payments on your behalf. You retain ownership and control of that account. Payments are processed by Square, Clover, and/or Stripe directly to you — we never take custody of your funds, and payouts, processing fees, refunds, and chargebacks are between you and those providers. You are responsible for keeping your merchant account in good standing and for the accuracy of your menu, prices, and availability. You may disconnect an integration at any time from the portal.

5. Your content and responsibilities

You are responsible for the accuracy and legality of the business information, menu, images, and other content shown on your site, and for complying with the laws that apply to your business (including food, tax, and consumer-protection rules). You grant us the license needed to display and operate that content as part of the service.

6. Third-party services

The service relies on third parties including Square, Clover, Stripe, Google, and our hosting and email providers. Your use of features that depend on them is also subject to their terms, and we are not responsible for their acts or outages.

7. Disclaimers and limitation of liability

The service is provided "as is" without warranties of any kind. To the fullest extent permitted by law, Catamaran Studios is not liable for indirect, incidental, or consequential damages, and our total liability for any claim is limited to the amount you paid us in the three months before the claim.

8. Termination

You may cancel at any time. We may suspend or end the service for non-payment, misuse, or legal reasons. On termination you keep your domain and your files, as described above.

9. Changes

We may update these Terms; material changes will be posted here with a new effective date. Continued use after a change means you accept it.
